Let us look at a popular case that occurred in Tempe.
On July 27, 2016, David Hollins robbed a Walgreens drug store wearing a mask and told the employees he had a weapon. Tempe Police responded to the incoming report that a possibly armed suspect was on the run in the Walgreen area. Officer Ouimette and his partner saw Hollins and pursued him.
Ouimette told him to stop, or he would shoot. Shortly after, he shot Hollins in the back after claiming that he saw Hollins reaching out for an automatic weapon that was never found. Hollins entered a maintenance shed at a senior living facility and died from the injuries.
Sarah Coleman (Hollin’s mother) sued the Tempe Police Department, and the jury decided in her favor for the battery claim against Officer Ouimette but remained deadlocked on the wrongful death claim. The judge declared a mistrial on this claim, and a new court date was later announced.
